These Terms of Service ("Terms") govern your access to and use of the LeadYou platform at app.leadyou.io ("Service"), operated by LeadYou ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

LeadYou is a lead management platform that enables businesses and agencies to:

• Capture and manage leads from multiple sources (forms, calls, ads, messages)
• Track call data through third-party integrations
• Receive leads from Facebook Lead Ads and Instagram
• Manage multiple client accounts under a partner structure
• Communicate with leads via email, SMS, and messaging channels

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Send unsolicited communications (spam) through the platform
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the integrity or performance of the Service
• Collect or harvest data from other users without their consent
• Resell or redistribute the Service without our prior written consent

5. Data Ownership

• You retain ownership of all data you upload or generate through the Service.
• We do not claim ownership of your leads, contacts, or business data.
• You grant us a limited license to process your data solely to provide the Service.
• Upon account termination, you may request export or deletion of your data.

6. Third-Party Integrations

The Service integrates with third-party platforms including Meta (Facebook/Instagram), Marchex, and others. Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Facebook & Instagram Platform Terms

If you use our Facebook or Instagram integrations, you also agree to:

• Comply with Meta Platform Terms
• Comply with Meta Developer Policies
• Only use lead data obtained through Facebook for purposes consented to by the user
• Not sell, license, or purchase any data obtained from Facebook

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for any loss of data, revenue, or business opportunities.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

• You may terminate your account at any time by contacting us.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately.
• We will retain your data for 90 days after termination, after which it will be deleted.
